Application of the general conditions of sale

These conditions govern only sales made from the Site, with consumers located in Metropolitan France and for products deliverable in this territory, to the exclusion of all other conditions.

For customers located outside Metropolitan France, they should contact us to determine the conditions under which sales could take place.

Placing an order implies the buyer's full and unreserved acceptance of these conditions, which he acknowledges being fully aware of, having read them prior to ordering on the Site.

As regulations prohibit the sale of alcohol to minors, any buyer ordering wine on the Site acknowledges that they are at least 18 years old on the date of the order. Alcohol abuse is dangerous for your health. Consume in moderation.

Ordering terms and conditions

The wines offered for sale on the Site are those described there, with an indication of their price, their essential characteristics and delivery costs, our company reserving the right to modify at any time the wines offered for sale on the Site.

For special or promotional offers, the validity period of these offers is that specified on the Site and these offers are applicable to any order placed before the expiration date of this validity period. After this date, our company reserves the right to modify its offers.

These general terms and conditions of sale also detail the terms and delivery times, the payment terms, the guarantees inherent to the wines and the conditions and procedures for exercising the right of withdrawal.

If the buyer does not consider himself sufficiently informed about the essential characteristics and prices of the wines, as well as about the elements described in the preceding paragraph, he may, prior to placing any order, request additional information by e-mail at the following address: accueil-cvp@estandon.fr or by telephone at the following telephone number: 04 94 37 21 00, Monday to Friday from 8:30 a.m. to 12 p.m. and from 1:30 p.m. to 4:30 p.m., our company undertakes to provide him with any additional information he may wish to obtain.

As soon as the buyer considers himself sufficiently informed, he can then place an order, it being specified that by placing an order, he implicitly acknowledges having obtained all the desired information.

Please note that given that the wines sold by our company are by nature limited in quantity, they are only offered for sale within the limits of available stocks.

In the event of a stock shortage, our company undertakes to inform the buyer within a maximum of 2 working days from receipt of the order, by email, possibly offering the buyer a wine of equivalent quality and price.

The buyer may then either cancel his order against reimbursement of the price paid, or order the natural wines and equivalent prices which may be offered to him, by informing our company of his choice by post or e-mail, within 7 working days following receipt by him of the information concerning the unavailability of the products ordered.

In the event of cancellation of the order, our company undertakes to reimburse the customer within a maximum of 7 working days from the date of cancellation of the order.

The buyer, to place an order on the Site, must follow the order process specified there and provide the requested information, necessary for the completion of the sale and delivery, in the areas reserved for this purpose, taking care, on this occasion, not to omit any information essential for the proper execution of the delivery (access methods, door codes, landline telephone number, etc.).

After validation of the order and payment by the buyer of the price thereof on the Site, the order is final and the sale is deemed to have been made, so that the order can no longer be subject to any cancellation or modification without the prior written agreement of our company, subject however to the exercise by the customer of his right of withdrawal described in these conditions.

The customer will receive written confirmation of their order by email, specifying their name and address, the price and characteristics of the wines ordered, the conditions, costs and delivery times.

As an exception, our company reserves the right to cancel an order placed by a buyer, if this order is abnormal in terms of the customer's true identity, the ownership of the payment method used by them and the delivery address provided.

In this exceptional case, our company reserves the right to request by email from the buyer all the required supporting documents regarding his identity, ownership of the means of payment used and the requested delivery address.

If the buyer fails to provide our company with the requested evidence by mail or email within 8 working days of receipt of the request made by our company, it will be entitled to cancel the order placed with it, by informing the buyer by email of its decision.

In the event of cancellation of the order, our company undertakes to reimburse the buyer within a maximum of 14 working days from the date of cancellation of the order.

Payment terms

Payment for purchases is made by bank card (Visa, Mastercard) in cash, when placing the order.

Payment is made on the banking server of our partner Strippe, which guarantees a real level of security during transactions. This means that no banking information is transmitted via our Site. At the time of payment, the buyer is connected in real time to the secure Strippe payment system. The bank ensures that the bank card is valid (no input errors, no opposition) and directly confirms the registration of the payment to the buyer by issuing a payment summary ticket with the transaction number, or informs the buyer that the transaction has been declined.

The buyer's order will be recorded and validated upon acceptance of payment by their bank.

The invoice corresponding to the wines ordered will be sent to the customer by email, at the latest upon delivery.

Any payment incident will authorize our company to cancel the execution of all current orders and to refuse any new order from the buyer, without the latter being able to claim any damages or compensation of any nature whatsoever.

Price

The prices of wines appearing on the Site are indicated in euros including all taxes (French VAT in force on the day of the order), for wines delivered to the buyer's address appearing in the order, excluding processing, packaging and delivery costs for the order.

Prices take into account the VAT applicable on the day of the order and any change in this rate will be automatically reflected in the price of wines on sale on the Site.

Participation in the costs of processing, packaging and delivery of the order amounts to:

- 20 euros including all taxes (French VAT in effect on the day of the order) for any order of an amount less than or equal to 99 euros including all taxes.

- 30 euros all taxes included (French VAT in effect on the day of the order) for any order of an amount between 100 euros and 299 euros all taxes included.

- these fees are free for any order of an amount greater than or equal to 200 euros including all taxes.

Our company reserves the right to modify the price of its wines at any time, it being specified that the price which will be invoiced to the buyer will be that in force on the date the order is placed.

For special or promotional offers, the validity period of the prices of the wines covered by these offers appearing on the Site is that specified on the Site, and these prices are applicable to any order received by our company before the expiry date of this validity period. After this date, our company reserves the right to modify the price of its wines.

Delivery times, costs and terms

The delivery of the wines will be carried out by our company or by a carrier mandated by it, to the address indicated in the order form, at the latest within 7 working days, from the date of formation of the sale as set out in these general conditions (receipt of the order form accompanied by payment of the price).

In the event of a delay in delivery, our company will inform the buyer by email as soon as possible and we will offer you a new date.

If our company is unable to ensure delivery of the wines ordered within the 7 working day period set above and if the delay in delivery exceeds 7 working days and is not due to a case of force majeure, the buyer may automatically cancel the sale.

In this case, the buyer must inform our company by mail or email, which will then reimburse them, as soon as possible and at the latest within 14 working days from receipt of the cancellation request, all sums that it may have received when placing the order.

The wines sold by our company travel at its own expense, risk and peril, the transfer of risks and responsibilities taking place upon delivery of the wines to the address appearing in the order, the buyer agreeing to be present to receive the delivery.

In the event of shortage, deterioration or non-conformity of the wines delivered in relation to the order, the buyer must indicate his reservations in writing on the delivery slip with his signature and must inform our company by mail or e-mail of these incidents, within 48 hours of delivery, in order to allow our company to preserve its rights vis-à-vis the carrier.

Satisfied or refunded: terms of exercising the right of withdrawal

In accordance with the provisions of Article L 121-21 of the French Consumer Code, the buyer has a period of 14 clear days from the date of receipt of the ordered wines to exercise their right of withdrawal. When the 14 clear day period expires on a Saturday or Sunday or a public holiday, the said period is extended until the following working day.

The buyer undertakes to inform our company of the exercise of his right of withdrawal, within the time limit stated above, by mail or by returning the withdrawal form downloadable from the Site.

In execution of his right of withdrawal, the buyer can return the wines ordered to our company, the costs of returning these wines being the responsibility of the buyer.

The return of wines must be made within 14 days of the buyer informing our company of the exercise of their right of withdrawal, to the following address: 727 boulevard Bernard Long - CS 90300 - 83175 Brignoles Cedex - France.

It is expressly stated that wines subject to the right of withdrawal exercised by the buyer will only be taken back if they are returned in their original packaging and in perfect condition for resale. Any wine that has been damaged or partially consumed will not under any circumstances benefit from the right of withdrawal provided for in this article.

Consequently, the buyer is advised to keep the original packaging until the end of the withdrawal period and when opening the package not to damage the packaging provided.

In the event that the buyer exercises the right of withdrawal, our company undertakes to reimburse the buyer for all sums received by it for the purchase of the wines (including transport and delivery costs), as soon as possible and at the latest within 14 working days following the date of receipt of the wines subject to the right of withdrawal at our company's premises, or the date on which the consumer provides proof of shipment of these wines.

The buyer's refund will be made by crediting his bank account.

If our company fails to reimburse the amounts owed to the buyer within the 14 working day period referred to above, it will automatically be liable to pay the buyer the late payment penalties set out in Article L 121-21-4 of the Consumer Code, under the conditions stipulated therein.

Legal guarantees

It is the buyer's responsibility to check that the wines ordered correspond to his needs, it being specified that prior to placing the order, he had the opportunity to obtain detailed information from our company on the characteristics of the wines ordered.

The use of our company's wines is the sole and entire responsibility of the buyer who must use them in accordance with their normal use and intended purpose.

Given the nature of the products sold, our company recommends that the buyer store them in a place that allows for good conservation and in particular in a cool and humid place, protected from light, sun, frost and rain and without sudden temperature variations.

Within the framework of the above provisions, our company undertakes to guarantee the wines sold against any defect or hidden defect, under the conditions specified in articles 1641 to 1648 and 2232 of the Civil Code and to guarantee the conformity of the wines under the conditions specified in articles L 211-4 to L 211-13 of the Consumer Code.

If the buyer considers that the wines delivered are tainted with defects or faults or non-conformity, he must notify our company by registered letter with acknowledgement of receipt, as soon as possible after the discovery of the defect, fault or non-conformity, specifying the nature and extent of the alleged defect, fault or non-conformity and providing all supporting documents as to the reality thereof.

The buyer must give our company every facility to carry out any observations it deems necessary.

If, following these observations, it turns out that the wines delivered were indeed defective, tainted with defects or non-compliant, then our company will undertake to replace these wines free of charge, to cover all costs of returning these wines and shipping wines free of defects, defects or non-compliance, or, failing to be able to replace the wines, to reimburse the buyer for the price of these wines.

Force majeure

Our company may be released from all or part of its obligations without being able to claim damages or compensation, if cases of force majeure or unforeseeable circumstances occur which prevent or delay the delivery of the wines ordered.

In particular, the following are considered to be cases of force majeure: storms, fires, floods, serious climatic phenomena, serious equipment accidents, mobilization, war, interruptions in transport, changes in laws or regulations relating to the products sold, shortages of raw materials used in the production of wines, strikes, whether total or partial, and more generally any element beyond the control of our company.

In the event of a case of force majeure, our company undertakes to notify the buyer as soon as possible by email.

The obligations of our company will then be suspended automatically from the date of occurrence of the event characterizing force majeure until the date of its end.

However, if the impediment linked to a case of force majeure lasts for more than one month, then the buyer may, if he so wishes, terminate the contract, by registered letter with acknowledgment of receipt, without this giving rise to any right to damages or compensation for the benefit of either party.

Our company would then undertake to reimburse the buyer for all sums paid to it, as soon as possible and in any event within a maximum period of 14 working days following notification of the cancellation of the sale by the buyer.

Intellectual property

The Site, all photos and all texts appearing on it are the exclusive property of our company and are protected under copyright and other intellectual property rights, so the buyer is prohibited from reproducing them, even partially, by any means whatsoever.

Any reproduction, and/or distribution and/or communication, and/or representation and/or reuse, and/or adaptation, in part or in full, in any form whatsoever, on any medium whatsoever and for any purpose whatsoever is prohibited without the prior written authorization of our company.

Applicable legislation / Competent jurisdiction

These general conditions and all sales made by our company are subject to French law.

In the event of disputes, the French courts will have sole jurisdiction.

Personal information

The data recorded by our company constitutes proof of the content and date of the order. They are archived for a period of 12 months and the buyer can access them by contacting our company either by email or by mail at the addresses listed in the "Legal Information" section.

The personal data collected by our company is used exclusively for processing orders and deliveries.

In accordance with the Data Protection Act of 6 January 1978, amended in 2004, the buyer has the right to access, rectify, delete or oppose any personal data concerning him/her.

To do this, the customer simply needs to make a request to our company, either by email or by post to the addresses listed in the Legal Information article.
